The following Website Terms of Use (hereinafter “Terms”) govern the terms of access to and use of the website https://aeteos.com (hereinafter the “Site”) as well as the rights and obligations of users of the Site (hereinafter the “User”).
Article 1: General
1.1 The Site is published by the company Aeteos SAS, whose registered office is located at 633 rue Nationale, Contoire-Hamel, 80500 Trois-Rivières, France, registered with the RCS of Amiens under the number 914 743 984 (hereinafter “the Company” or “Aeteos”).
1.2 By using the Site, the User fully accepts these Terms, which the User declares to have read and understood in their entirety. The User should not continue using the Site if they disagree with any part of the Terms.
1.3 The present Terms are available and accessible online. They come into effect on the date they are published online and are binding until new Terms replace them. The current Terms supersede and replace any previous version.
1.4 Aeteos reserves the right to modify the Terms at any time, without notice or compensation, which the User expressly accepts. The User is invited to regularly consult the Terms to ensure that the User’s use of the Site is in accordance with the conditions set by the latest applicable Terms.
Article 2: Accessing the Site
2.1 The Site can be accessed by any User who has internet access. All costs associated with access to or use of the Site and its contents are solely borne by the User. The Company does not guarantee the availability of the Site, nor the availability of all or part of its contents. The Company reserves the right to modify the Site at any time. The Company strives to regularly update the Site, but the Company does not guarantee that the Site’s content is accurate, complete, or up to date.
2.2 Aeteos cannot be held responsible for any damages, direct or indirect, such as material and/or financial damages, loss of data, and/or loss of programs, resulting from access to and/or use of the Site and/or the information it contains.
Article 3: Links
3.1 The Site may contain purely informational hypertext links to third-party websites (“External Sites”). External Sites are published by independent third parties. The presence of a hypertext link on the Site to an External Site should not be interpreted as an endorsement by Aeteos of the External Site or its contents. Aeteos shall not be held liable for the content, advertisements, products, services or any other information or data available on or from an External Site, nor for any damages or losses arising from or related to the use of an External Site.
3.2 Aeteos authorizes the creation of hyperlinks to the Site, provided they are made in a manner that does not harm the interests, notoriety, reputation, or brand image of Aeteos and are in full compliance with any applicable legal and regulatory requirements (the “Authorization”). Aeteos reserves the right to withdraw, at its sole and entire discretion and at any time, the Authorization, without notice and without notification. When creating a link to the Site, it is strictly forbidden to: (a) create a hyperlink that would give the impression that there is a form of endorsement, association, partnership, or support from Aeteos of the User or any third-party individual or entity; (b) for anyone (the “Link Author”) to create a hyperlink to the Site on an External Site that the Link Author does not own; (c) create a link to the Site whose existence or content is likely to harm the interests, notoriety, reputation, or brand image of Aeteos; (d) create deep links to any or all of the Site using a transclusion technique (framing, inline linking, etc.); and/or (e) create a link to a part of the Site other than the homepage. Article 4: Security
4.1 The User undertakes not to disrupt the proper functioning of the Site and shall not carry out any operation that could lead to fraudulent access. The User will ensure, in particular, not to introduce any viruses or any other harmful technology to the Site or through it.
4.2 Aeteos makes its best efforts, in accordance with industry standards, to keep the Site safe and secure. It cannot, however, guarantee the Site’s security. The User acknowledges and accepts the characteristics, limitations, and risks of the internet. The User is invited to report to the Company any difficulty they may notice in the use of the Site. The User agrees to have operational and up-to-date antivirus software before browsing the Site.
4.3 The User agrees to take all appropriate measures to protect their own data and/or software from contamination by any potential viruses or other anomalies of any kind on the internet network, and the Company cannot be held liable for any damage caused by the User’s failure to comply with this security requirement.
Article 5: User’s Undertakings
The User shall not use the Site for illegal purposes. The User shall use the Site in compliance with all applicable laws and regulations, and shall not act in such a way that may harm the interests, notoriety, reputation, or brand image of Aeteos. Without limiting the foregoing, the User is shall not: restrict or interfere with use of the Site by another person, including through a denial of service attack; use a robot, spider, site search/retrieval application or other device to retrieve or index any or all of the Site; gain unauthorized access to the Site, the server on which the Site is hosted, or any server, computer or database connected to the Site; and/or transmit viruses, worms, defects, Trojan horses, or other destructive elements.
Article 6: Intellectual Property
6.1 The Site, as well as the trademarks, logos, and any other distinctive signs of the Company (hereinafter referred to as the “Company’s Elements”) are the exclusive property of the Company and/or its partners and/or third parties and are protected by copyright, trademark rights, patent rights, and/or other intellectual property rights. Any copying, modification, reproduction, distribution, publication, integration on any medium whatsoever, adaptation, transfer or assignment, licensing, sublicensing, guarantee and/or transmission in of the Company’s Elements, without the express authorization of the Company or a third-party rights holder, is strictly prohibited. The Company grants the User only a right of access to the Site, on a non-exclusive, personal, non-transferable basis, in accordance with the provisions of these Terms.
6.2 Any use of automated systems or software to extract data from the Site (data mining, web scraping, text mining) is prohibited. The Company expressly reserves its rights in this regard, in particular in the application of article 4.3 of Directive (EU) no 2019/790 of April 17, 2019 on copyright and related rights in the Digital Single Market.
6.3 The User expressly acknowledges and accepts that the Company has the right to use, in any form and for any purpose whatsoever, any feedback, idea, opinion, comment, suggestion, data, or any other form of information transmitted by the User to the Company without the User being able to claim any compensation of any kind whatsoever.
Article 7: Personal Data
Aeteos processes Personal Data in strict compliance with French and European laws and regulations on data protection, including the provisions of the law n° 78-17 of January 6, 1978 known as “Informatique et Libertés” and those of Regulation nᵒ 2016/679 of April 27, 2016 on data protection. Article 8: Cookies
The Site’s use of cookies is carried out in accordance with our Privacy Policy.
Article 9: Assignment
The Company may freely assign its rights and obligations arising from these Terms.
Article 10: Miscellaneous
Any delay or failure by the Company to assert or exercise any of its rights under the present Terms shall not operate as nor be construed as a waiver thereof.
If any clause or provision of these Terms is deemed invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other clause or provision of these Terms or invalidate or render unenforceable such clause or provision in any other jurisdiction.
Article 11: Applicable Law and Choice of Forum
These Terms are governed by French law. Any dispute arising out of or relating to these Terms or the use of the Site shall be finally decided by the competent courts of Amiens, France, which shall have exclusive jurisdiction in all such matters, including in the event of emergency or summary proceedings, third-party claims, or multiple defendants.
